Terms of service

1. Acceptance of terms

By accessing or using Kawaa's email verification service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of service

Kawaa provides email verification services including real-time API verification, bulk email validation, and related features. The Service helps businesses verify email addresses to improve deliverability and reduce bounce rates.

3. Account registration

To use the Service, you must:

Create an account with accurate information
Be at least 18 years old
Maintain the security of your account credentials
Notify us immediately of any unauthorized access

4. Acceptable use

You agree NOT to use the Service to:

Verify email addresses without proper consent or legal basis
Send spam or unsolicited communications
Violate any applicable laws or regulations (including CAN-SPAM, GDPR)
Attempt to circumvent rate limits or abuse prevention measures
Reverse engineer or attempt to extract source code
Resell the Service without a white-label agreement
Use the Service for any illegal or harmful purpose

5. API usage

API access is subject to per-key, per-plan, and shared platform throttles to protect service stability. Excessive usage may result in temporary throttling or suspension. You are responsible for securing your API keys.

6. Payment terms

Kawaa plans and credit packs are sold through Link, LLC ("Link"), a Stripe company, which is the merchant of record for your purchase. Link takes your payment, issues and emails your receipts and invoices, and handles questions about payments. The terms Link shows at checkout also apply to your purchase, and card statements show the charge as LINK.COM* KAWAA. A subscription started before we moved to Link continues to be billed by Kawaa until it ends
Subscription fees are billed monthly in advance
Prices exclude taxes. Any sales tax, VAT or GST charged on a purchase is added to the price and shown at checkout and on the invoice
All payments, including subscription fees and credit pack purchases, are non-refundable. Link may refund a payment under its own terms, and nothing in these Terms limits a right to cancel or to a refund that the law where you live gives you. If you believe you were charged in error, contact support@kawaa.com
When a subscription payment is made, your plan's credit allowance for that billing period is added to your credit balance. Unused plan credits carry over from one billing period to the next while your subscription stays active
Credits bought as one-time credit packs do not expire
When your paid plan ends, or your account is moved to the Free plan because your subscription is unpaid or paused, the unused part of the last plan allowance added to your balance is removed. Credits used since that allowance was added count against it first. Credits from credit packs, and plan credits carried over from earlier billing periods, stay on your account
If you cancel your subscription, it stays active until the end of the billing period you have paid for, and is not renewed
Moving to a higher paid plan takes effect immediately: you are charged the prorated price difference for the rest of the billing period, and a matching share of the higher plan's extra credits is added once that payment goes through. Moving to a lower paid plan takes effect at your next renewal. Changing plans does not remove credits from your balance
We reserve the right to change pricing with 30 days notice
Failed payments may result in service suspension

7. Service level

We monitor service health in real time and work to minimize downtime, but we do not guarantee uninterrupted service or publish a formal uptime SLA on this plan. Scheduled maintenance will be announced in advance when possible. Check our status page for current service status.

8. Data processing

By using the Service, you authorize us to process email addresses you submit for verification purposes. You represent that you have proper consent or legal basis to process these email addresses.

Our Data Processing Agreement is part of these Terms and is incorporated into them by reference. It applies automatically whenever we process personal data on your behalf, and no signature is needed for it to apply. A copy countersigned by Kawaa is available on request by email to privacy@kawaa.com.

9. Intellectual property

The Service, including all software, APIs, and documentation, is owned by Kawaa. You are granted a limited, non-exclusive license to use the Service according to these Terms.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAWAA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE 100% ACCURACY OF VERIFICATION RESULTS. Email deliverability depends on many factors beyond our control.

12. Indemnification

You agree to indemnify and hold harmless Kawaa from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account for violation of these Terms. You may cancel your account at any time. If you cancel a paid subscription, it stays active until the end of the billing period you have paid for (see section 6). Upon termination of your account, your right to use the Service ceases immediately.

14. Changes to terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
